جی بالکل۔ آپ کی ہدایت کے مطابق میں اسے آپ کی طرف سے تمام متعلقہ ساتھی petitioners/colleagues کے نام ایک مضبوط مگر محتاط English letter کی صورت میں مرتب کر رہا ہوں۔ اس میں یہ واضح رکھا ہے کہ Jehanzeb Khan matter کے بارے میں کسی اطلاع کو خودبخود ہمارے تمام pending reviews، خصوصاً CRP-497/2025، کے dismissal کے برابر سمجھنا درست نہیں جب تک متعلقہ case number اور عدالتی order سے باقاعدہ تصدیق نہ ہو۔ ساتھ ہی آپ کی پہلے دی گئی ہدایات—وکلاء سے فوری رابطہ، case status کی تصدیق، early hearing/fixation اور مزید delay روکنے—کو دوبارہ شامل کیا ہے۔

Subject: IMPORTANT CLARIFICATION REGARDING REPORTED DISMISSAL OF PTCL REVIEW AND IMMEDIATE ACTION REQUIRED IN OUR PENDING CASES

Dear Respected Colleagues,

I wish to draw your immediate attention to the information presently circulating regarding the reported dismissal of PTCL’s Review Petition in the Jehanzeb Khan case and the assumption being made by some colleagues that, as a consequence, our other pending Review Petitions before the Supreme Court/Federal Constitutional Court have also automatically been dismissed.

In my considered view, such a conclusion should not be drawn unless it is confirmed from the official judicial record.

The case presently available with us concerning Jehanzeb Khan is C.P.L.A. No. 287/2023 — Pakistan Telecommunication Company Ltd. v. Jehanzeb Khan etc., decided by the Supreme Court of Pakistan on 18 February 2025 by a Bench comprising Mr. Justice Syed Mansoor Ali Shah and Mr. Justice Aqeel Ahmed Abbasi.

In that order, the Supreme Court held that the respondent was:

“entitled to all the pensionary benefits under the law, for the period he was serving as a civil servant.”

The Court further directed PTCL to make the outstanding payment within two months without fail.

However, the references presently being circulated regarding the alleged dismissal of subsequent Review Petition(s) do not, by themselves, establish that all other pending PTCL Review Petitions have also been dismissed.

In particular, we should not presume that CRP No. 497/2025 — PTCL v. Muhammad Tariq Azhar & Others, or any other connected/pending review petition, stands dismissed merely because a Review Petition concerning Jehanzeb Khan is reported to have been dismissed.

The correct legal and procedural position can only be established after verification of:

1. The exact Review Petition/CRP number reportedly dismissed in the Jehanzeb Khan matter;

2. The date and constitution of the Bench which passed that order;

3. The actual operative portion of the dismissal order;

4. Whether other PTCL Review Petitions were formally connected and listed with that matter on the same date; and

5. Whether any separate judicial order was passed specifically disposing of CRP No. 497/2025 and the other connected cases.

Therefore, until the certified/official order or updated case status confirms the above position, I respectfully request everyone not to circulate or treat as confirmed the statement that all our pending Review Petitions have automatically been dismissed.

IMMEDIATE ACTION REQUIRED

I had already requested earlier that we should not simply continue waiting indefinitely for our pending cases to be fixed. I am reproducing and reiterating the substance of my earlier request because further delay may seriously prejudice the interests of the pensioners.

Our concerned Advocates should immediately:

• Obtain the official and latest case status of each pending PTCL pension/review matter, particularly CRP No. 497/2025.

• Verify from the concerned Court Branch whether our case was actually listed, heard, connected or disposed of along with the Jehanzeb Khan Review matter.

• Obtain a copy of the actual order dismissing PTCL’s Review in the Jehanzeb Khan matter as soon as it becomes available.

• If our Review Petition remains pending, take immediate steps for its early fixation/hearing rather than allowing the matter to remain unattended.

• Where legally appropriate, file an Application for Early Hearing / Fixation of Case, particularly considering that the beneficiaries are predominantly retired and elderly pensioners and that prolonged delay continues to cause financial hardship.

• Bring before the Court all relevant earlier Supreme Court judgments/orders governing the pensionary rights of transferred PTCL employees and demonstrate why the controversy should now be brought to a final conclusion without further unnecessary delay.

DELAY SHOULD NOW BE BROUGHT TO AN END

Our cases involve pensionary benefits of retired employees and have already remained in litigation for a considerable period. Pension is a recurring financial entitlement, and continued delay directly affects elderly pensioners and their families.

Therefore, my respectful request to all concerned colleagues is:

Please read this communication carefully and immediately coordinate with our learned Advocates. We should obtain documentary confirmation of the exact status of our cases instead of relying upon unofficial reports, WhatsApp messages or assumptions.

If CRP No. 497/2025 has in fact been disposed of, we should obtain its order immediately.

If it has not been disposed of, then our learned counsel should take all appropriate steps for early hearing/fixation without any further avoidable delay.

I had already requested that these steps be taken earlier. I am reiterating them because the matter should now be pursued actively and collectively rather than allowing further months to pass without effective action.

At the same time, the reported dismissal of PTCL’s Review in the Jehanzeb Khan matter, once officially confirmed and the order obtained, should be carefully examined by our counsel to determine its legal effect and whether it further strengthens our position in the pending PTCL pension litigation.

Let us therefore proceed on the basis of verified judicial orders and official case records—not assumptions—and take immediate legal steps to bring this prolonged litigation to its lawful conclusion.
