Clarification of HSC verdicts reported in NLR 1996 Service 43 ,SC Judgment Dt.3-12-1995

Dear Ghafoor Bhutto sb this regard I have submitted a detail reply to Masood Bhattie sb. It may be possible , as Masood Bhattie mentioned that that the judgement of SC of  NLR 1996 Service 43 ,SC Judgment Dt.3-12-1995 was nullified by SC but in other judgement  the SC clearly mentioned that 

"the employees of PTC are not Civil Servant for the purposes of filling case in FST"

 [NLR 1993 TD 352] . 

In  other judgement SC mentioned that 

"Transferred employee in PTC  from T&T having the status of civil servant  as on his transfer to PTC , carried terms and conditions of service which he was enjoying T&T Dept, such terms and conditions could not be changed or varied to disadvantage of civil servant

 [1997 PLC (CS) 631].

Similar  type directive given in [1996 PLC 545] with reference to Civil Servant Act 1973, S.2(1)(b) Constitution of Pakistan (1973) Art 212(3) that PTC did not change their status as Civil Servant.

So you can say that you are not Civil Servant but you are enjoying the status of Civil servant in PTCL.

I am greatly sticked on the verdicts , given by three member HJs of HSC in Masood Bhattie case on 7th October 2011 which is now reported  in 2012 SCMR 152 and then verdicts of 5 member HJs bench of SC of 16-3-16 ,dismissing the CRP of PTCL against Masood Bhattie case & the decision of HSC in Masood Bhattie case attanid finally and now became a law.

To satisfy your self ,  think when you appointed in T& T dept , you were called Civil Servant of GoP. Your Terms & Conditions of the Service as written in Section-3 to Section-22 of the Civil servant Act 1973.So when you transferred to PTC in Dec-1991 under Section 9(1)  of PTC Act 1991 , you  became the employee of Corporation on the same terms and conditions of service which you were entitled immediately before such transfer ( ie in T& T). Since you were called Civil servant of GoP in T& T  being govt Deptt and statutory rules (mentioned in Civil Servant Act 1973) were being applicable on you but when you transferred to PTC you became the employee of PTC  and thus called the employee of Corporation but you were being governed by Stauory Rules of GoP as in T&T. But when you transferred to PTCL  and  became the employee of PTCL wef 1-1-1996 as  per Section -35 (2) , 36(1) & 2 of PT ( re-Organization ) Act 1996 you were called PTCL employees but your Terms & Conditions of Service remained same as was in T&T when you were called civil servant ,in PTC when you were called Corporation employee . 

Here in PTCL it is clerified in Sectin 36(1) & 2 of PT ( re-Organization ) Act 1996 that firstly your terms and conditions of service ( as in T&T & in PTC) could not be altered for your disadvantage and GoP is the gaurenter  of your such existing terms and conditions of service and rights , including pensionary benefits etc. 

So what your status in PTCL now ???? Correctly you are now PTCL employee but having the same terms and conditions of service and rights, including pensionary benefits ( which you had in T&T and then in PTC etc) but here in PTCL with the guarantee of GoP ,as stated above .

I think , now you will be satisfied about your status in PTCL

The 5 members larger bench of the Hon'ble Supreme Court in 2016 SCMR 1362 has decided that PTC and another vs Riaz Ahmed and 6 other PLD 1996 SC 222 = NLR service  SC 43 incorrectly decided. Thus have no value.

It is just to clear that transferred employees are no more civil servant after judgment 2016 SCMR 1362 to avoid further confusion.
