نوٹ:- ۲ نومبر ۲۰۲۱ کو اسلام ھائی کوڑٹ کے دورکنی بینچ نے پی ٹی ای ٹی اور پی ٹی سی ایل کی طرف سے دائر کردہ تمام انٹرا کوڑٹ اپیلیں ڈسپوزڈ آف کردیں اور صرف پی ٹی سی ایل ریٹائڑڈ ملازمین پٹیشنروں کو گورمنٹ کی اعلان کردہ سالانہ پنشن انکریز ادا کرنے کا حکم دیا جو ٹی اینڈ ٹی میں بھرتی ھوئیے اور جو سول سرونٹ ایکٹ 1973 کی شق ۲ بی ون میں دی گئی سول سرونٹ کی تعریف میں آتے ھیں اور جو نارملی ریٹئیڑڈ ھوئیے ھوں یعنی بغیر کسی گولڈن شیک ھینڈ یا وی ایس ایس آپٹ کرکے ۔ اس طرح سنگل بینچ اسلام آباد ھائی کوڑٹ ۳ مارچ ۲۰۲۰ اس فیصلے کو ری کنفرم کردیا جس نے ایسا ھی حکم جاری کیا تھا اور ایسے سب کو ساٹھ دن کے اندر اندر انکے بقایا جات کو کیلکولیٹ کرکےدیا جائیے ۔ لیکن پی ٹی ای ٹی نے بجائیے حکم پر عمل کرنے کے اس کے خلاف انٹرا کوڑٹ اپیلیں دائر کردیں جو سب سب کے سب اس مندرجہ بالا حکم کے ساتھ 2 نومبر کو ڈسپوزڈ آف کردی گئیں ۔ لیکن یہ لوگ اب بھی مستی کریں گے ۔ اسلئیے ضروری ھے جن ایسے پٹیشنرس نے گورمنٹ کی اعلان کردہ پنشن انکریزز دینے کی اپنی پٹیشن میں pray کی تھی انکو چاھئیے وہ انکو ۱۵ دن میں پیمنٹ کرنے کا نوٹس دیں کے انکو گورمنٹ کی اعلان کردہ پنشن انکریزز کے بقایا جات سالانہ پنشن انکریزز گورمنٹ کئی جائیں اور نہ دینے کی صورت انکے خلاف توھین عدالت کی کاروائی کی دھمکی دی جائیے۔ اب یہ لوگ سپریم کوڑٹ میں اسکے خلاف بھی اپیل نھیں کرسکتے کیا جواز بنائیں گے؟ کیونکے یہ لوگ اسی طرح کے سپریم کوڑٹ کے 15 فروری 2018 کے حکم کے تحت تقریبن 343 ایسے ھی پٹیشنروں کو فروری 2018 میں ، عدالتی دئیے گئیے 15 دن کے ٹائیم پیریڈ کے اندر پنشن انکریزز بقایا جات کی مکمل پیمنٹ ادا کرچکے ھیں اور انکو سالانہ پنشن انکریز ، گورمنٹ کی اپنے ریٹئڑڈ سول سرونٹ کو اعلان کردہ پنشن انکریز کے مطابق ھی کرتے ھیں ۔ میں نے انکو پیمنٹ ادا کرنے کے نوٹس دینے کا ایک سمپل تیار کردیا ھے جو ھر پٹیشنر individually بھر کر بزریعہ ٹی سی ایس متعلقہ افراد کو بھیج دیں۔ اگر وہ بھیجنا چاھتے ھوں اور اسکا بھیجنے اور وصول کرنے مکمل معلومات اور رسید اپنے پا س بطور ثبوت اور اسکی کاپی ساتھ بطور رکھیں۔ ضروری نھیں وہ اسی سیمپل کو فالو کریں۔ وہ اپنی طرف سے اس سے اچھا بناکر بھی بھیج سکتے ھیں ۔ شکریہ واسلام طارق 11 نومبر 2021 Sample of Notice to PTET for Payment of GoP Pension increase to the entitled Petitioners , in accordance to verdicts of IHC of dated 2-11-2021, while disposing off PTET and PTCL Intra court appeals To, 1. Pakistan Telecommunication Employees Trust (PTET) Through its Managing Director Tele-House Mauve Area, G-10/4, Islamabad 2. General Manager (PTET) Pakistan Telecommunication Employees Trust (PTET) Tele-House Mauve Area, G-10/4, Islamabad Subject:- Notice for payment GoP announced pension increases to the Petitioners , entitled for such GoP Pension increases being Civil Servant as defined under Sanction 2(1)(b) of Civil Servant Act 1973 as ordered by Single Bench Judge of IHC on the 3rd March 2020 , which was reconfirmed by the double bench of IHC on the 2nd November 2021 , while disposing off all Intra Court Appeals, filed by PTET against such orders of dated 3rd March 2020 by single bench of IHC Dear Sir , Please refer to the judgement of Islamabad High Court dated 3rd March 2020 passed in the Writ Petition No WP__________titled_____ and in intra court appeal ICA No ____titled PTET vs _________ , announced on the 2nd November 2021, which has been disposed off accordingly with the order contained in Para-19(i) that “the employees of erstwhile T& T Department who fall within definition of Civil Servants as provided under Sanction 2(1)(b), hence , enjoy the statutory protection under sanctions3 to 22 of the Civil Servant Act , 1973 , hence are entitled to increase in pensionary benefits as are being enjoyed by the government servants except where there is variation in terms and conditions of service,including receipt of pensionary benefits which are different from ones enjoyed by the government servant and there is consent of the employee and some compensation has been afforded to him”. So in this connection it is stated that:- 1. I ____ s/o______ retired __________(B- ) , having PPO Ref #___________ & petitioner in the Writ Petition No WP________ titled _________, was appointed in erstwhile T&T Department through FPSC on ___________ as _____( B-) and retired on ______ as ________(B-) at the Superannuation age of sixty years OR had taken the premature retirement on _______ as per Federal Pension Rules. Consequently , I am rightly entitled to increase in pensionary benefits enjoyed by the government retired servants as I fall within definition of Civil Servants as provided under Sanction 2(1)(b), of the Civil Servant Act , 1973. 2. In my Writ Petition No WP________ titled _____ , I had prayed for the grant of GoP announced pension increases as being paid to its retired civil servants .Which had been discontinued wef 1st July 2010 by the PTET , unlawfully from the retired PTCL employees having statutory rules protection , such GoP increased annually pension was being paid to them since long . The Honourable apex Court had directed in the order of dated 3rd March 2020 “ that the Petitions filled by the Petitioners who were the departmental employees(ie the employees of T&T Department who were transferred to PTC and further transferred to PTCL by virtue of the provisions of 1991 Act and 1996 Act) praying for the payment of pension with increases at the same rates paid by the Federal Government to the retired civil servants from time to time , are allowed. PTCL and PTET are directed to calculate the arrears in pension, and pay the same to them within period of sixty days from this Judgement”. But instead of paying such GoP increases pension to petitioners concerned , who were rightly entitled for the same , PTET had filed Intra Court Appeals against them. An Intra court appeal ICA No _______ had been filled against such favourable decision of apex court of dated 3rd March 2020 on my a Writ Petition _________. On the 2nd November 2021 , by reconfirming the order of honourable apex court of dated 3rd March 2020 in,PTET Intra court appeals were disposed off accordingly. In view of above stated reasons and justification , it is requested that GoP announced pension increase be paid to me within fifteen days , after calculating arrears , as it had been paid by the GM PTET to similar category of 343 petitioners within fifteen days in the month of February 2018, as per order of dated 15th February of two member bench Judges of HSCP . If such payments of GoP pension increase with arrears are not paid to me , in due time of course , then I will be constrained to file contempt of court case against you all in the proper court of law.
