Assalam-o-Alaikum,


I have received numerous messages regarding what steps the former PTCL employees, who were part of PTCL on January 1 and later retired or left PTCL for any reason, should take now. I had previously explained this in detail in my Article 96, but perhaps some individuals were unable to read it due to its length or did not understand it. Nevertheless, I have simply pasted the relevant portions below so that you can carefully read them.


"In this order, the court used the term "aggrieved employees," not complainants or appellants. Therefore, all former PTCL employees who were employed in PTCL from January 1, 1996, until June 30, 2012, or earlier must obtain their data and contribution amount from PTCL and issue their registration card so that these former employees can also benefit from EOBI benefits. This becomes an essential requirement for EOBI because this directive was issued by its legal authority, the Adjudication Authority. Now it is up to the courts, and they must follow the legal procedure to implement it. I believe that every former PTCL employee should submit a copy of their complete CV along with a copy of their identity card and the court order to the EOBI office of their district, established in compliance with the court order on February 21, 2018. Check their website www.eobi.gov.pk for information about their district offices in every city of Pakistan, utilize it, and learn how they can benefit from accurate information."


Furthermore, I have included the questionnaire issued by the head office of EOBI located in PECHS Karachi in this regard, along with the answers in highlight, for your understanding. I have also pasted the judgment of the Supreme Court dated March 1, 2016, where the court dismissed PTCL's appeal and ruled that it should be registered from the time the lawsuit was filed. However, PTCL partially complied with it by only registering the PTCL employees who were in service on June 30, 2012. Subsequently, any employee retired began receiving EOBI pension if they reached the age of sixty despite being transferred employees, while those in government service were already receiving government pension.


I believe that since PTCL did not fully comply with the partial action on the Supreme Court's March 1, 2016, order, a case of contempt of court should be filed against PTCL and also take EOBI as a party, gathering EOBI's non-registered PTCL former employees to form a case of contempt against the Supreme Court. However, it is necessary to seek advice from a reputable and well-known lawyer , also in this regard.Thank you.
