Updated Legal Commentary on PTET’s Malafide Conduct


The conduct and behaviour of General Manager PTET, Mr. Farooq, and the role of Mr. Shahid Anwar Bajwa, ASC, towards Non-VSS (normally retired) PTCL pensioners is highly deplorable, mala fide, discriminatory, and constitutes a brazen Contempt of Court.

In the Supreme Court order dated 15 February 2018, Mr. Shahid Anwar Bajwa, ASC, appearing for PTCL/PTET, gave a solemn, categorical, and unconditional undertaking before Justice Gulzar Ahmed that all petitioners besides VSS optees would be granted full government pension along with incentive pay. He assured the Court that no recovery or deduction would be made and that government-announced increases would be extended from time to time. This undertaking was given on behalf of PTCL/PTET and bound the institution.

Pursuant to this undertaking, PTET released government pension and arrears to 342 Non-VSS pensioners across all grades (Grade 1 to 15). However, after the Supreme Court judgment dated 10 July 2025, GM PTET Mr. Farooq has willfully betrayed that undertaking and adopted a hostile, vindictive, and discriminatory policy.

Under Mr. Farooq’s leadership, PTET is systematically denying full GoP pension to Non-VSS pensioners in Grade 1 to 16 by arbitrarily and illegally declaring them “workmen”, thereby depriving them of their vested rights. This is being done despite the clear 2018 undertaking and the 2025 judgment, which protect normally retired (Non-VSS) pensioners.

Mr. Shahid Anwar Bajwa’s role is equally questionable. Having given a solemn undertaking before the apex Court on behalf of PTET, he and his client are now attempting to wriggle out of it through selective implementation and artificial classifications. This amounts to playing a double game with the Honourable Supreme Court and the pensioners.

The deliberate, concerted, and malicious efforts of GM Farooq and the backtracking from the undertaking given by Mr. Shahid Anwar Bajwa are causing extreme financial hardship and mental torture to elderly Non-VSS pensioners who served the nation with honesty and dedication. Such behaviour brings the entire judicial process into disrepute and deserves strict contempt action, including personal liability and removal from office.

Mr. Farooq,

You are hereby served with this strong and final legal notice for your obstructive, vindictive, discriminatory, and contemptuous conduct towards Non-VSS (normally retired) PTCL pensioners, especially those in Grade 1 to 16.

On 15 February 2018, your counsel Mr. Shahid Anwar Bajwa, ASC, made a solemn and binding undertaking before the Honourable Supreme Court that all petitioners besides VSS optees shall be paid full government pension with incentive pay and admissible increases. Acting on this undertaking, PTET extended these benefits to 342 Non-VSS pensioners of all grades without any objection.

It is shocking and unacceptable that after the Supreme Court’s clear judgment dated 10 July 2025, you, as General Manager PTET, have launched a deliberate campaign to deny rightful GoP pension to Non-VSS pensioners in Grade 1 to 16 by falsely and maliciously labelling them as “workmen”. This artificial and illegal classification is a blatant attempt to frustrate the Supreme Court orders and betray the solemn undertaking given by your counsel Mr. Shahid Anwar Bajwa.

Mr. Shahid Anwar Bajwa gave a categorical assurance to the apex Court. Backtracking from that undertaking through selective and discriminatory implementation amounts to misleading the Court and playing a double game with thousands of elderly pensioners.

VSS optees were explicitly excluded from the 2018 undertaking. However, normally retired Non-VSS pensioners are fully entitled to dynamic government pension benefits. Your persistent refusal to honour the undertaking and the Supreme Court judgment is illegal, mala fide, and in flagrant contempt of the highest Court of the country.

You are therefore strictly directed to:

1. Immediately process and release full Government of Pakistan pension, all arrears, and admissible increases to all Non-VSS (normally retired) pensioners, including Grade 1 to 16, without any further delay or illegal classification.

2. Complete the entire process and make payments within 15 days from the receipt of this notice.

Take explicit and final notice that any failure or delay in compliance shall result in the filing of Contempt of Court proceedings against you personally (Mr. Farooq), Mr. Shahid Anwar Bajwa, ASC, the Chairman PTET, and the Board of Trustees before the Honourable Supreme Court of Pakistan.

Furthermore, due to your continued hostile, discriminatory, and defiant attitude towards PTCL pensioners, we demand your immediate removal from the post of General Manager PTET. Your presence in this position is prejudicial to justice and the rights of retired employees.

This is your last and final warning. Any further defiance will invite the strictest legal consequences.
