Subject: Joint Representation for Full Financial Compliance of Supreme Court Judgment dated 10 July 2025 — Correct GoP Pension Fixation (including FY 2024–2025) and Payment of Complete Arrears to All Eligible Ex-T&T / PTCL Pensioners

Respected Sir,

We, the undersigned affected Ex-T&T / PTCL pensioners whose cases are being processed/handled by PTET, submit this Joint Representation for immediate corrective action and complete implementation of the binding judgment of the Honourable Supreme Court of Pakistan dated 10 July 2025 (Civil Appeal No. 1509 of 2021 etc.).

This representation is issued as a collective notice of a systemic and repeated error being observed during the implementation process and is not restricted to any one individual. If PTET fails to rectify within the stipulated time, the appropriate legal forum for enforcement shall be the Islamabad High Court, including contempt proceedings where applicable.

1) Background and Legal Position (As Settled by the Supreme Court)

The Supreme Court has clearly settled that:

 • Employees originally appointed in the T&T Department (Government of Pakistan) are to be treated as Government employees for pension purposes, and

 • Their pension must be fixed and paid strictly under Government Pension Rules, and

 • This right is not conditional upon grade, cadre, or FPSC examination, and cannot be restricted to limited categories.

Therefore, any implementation that attempts to limit eligibility by grade (e.g., BPS-17 and above), cadre label, or FPSC status is contrary to the settled legal position and defeats the very purpose of the judgment.

2) Current Implementation Issues Observed (Systemic Non-Compliance)

During the ongoing implementation, we have observed the following serious issues:

 1. Artificial restriction of applicability to limited categories of pensioners, instead of implementing the judgment across all eligible Ex-T&T appointees.

 2. Incorrect and reduced fixation of GoP monthly pension for FY 2024–2025, based on a lower/incorrect foundation.

 3. Arrears are not being calculated fully and correctly, and the paid amounts appear short of what is lawfully due.

 4. The same pattern of flawed calculation is appearing across multiple pensioners, showing a collective/systemic error, not isolated mistakes.

Result:

 • Each pensioner’s monthly pension is being understated;

 • Arrears worth lakhs (and in many cases millions) of rupees are being withheld through incorrect fixation;

 • The judgment is not being complied with in full financial terms, which is an essential part of compliance.

3) Our Joint Demands (Reliefs Sought)

In light of the above, we jointly demand that PTET:

A. Correct Pension Fixation

 1. Re-fix GoP pension of all eligible Ex-T&T / PTCL pensioners strictly under Government Pension Rules, without any grade/cadre/FPSC-based restriction.

 2. Correct the FY 2024–2025 monthly GoP pension fixation on the correct base and correct method.

B. Complete Arrears Payment

 3. Prepare and issue complete, accurate arrears calculation for each affected pensioner (from the legally due date as per Supreme Court implementation framework) and pay the full shortfall without delay.

 4. Provide each pensioner a written calculation sheet showing:

 • The adopted base pension

 • Year-wise GoP increases applied

 • The revised monthly pension year-wise

 • Total arrears payable

 • Amount already paid (if any)

 • Balance payable

C. Standardized Implementation (To Stop Repeat Errors)

 5. Issue a uniform and transparent SOP / standard calculation method for all such cases to ensure permanent future compliance and to prevent repetition of the same under-fixation across pensioners.

D. Written Confirmation

 6. Issue a written confirmation that implementation is being done for all eligible Ex-T&T original appointees, not restricted to any subset.

4) Time Limit for Compliance

We request PTET to complete the above corrective actions within 15 days from receipt of this Joint Representation and to provide written confirmation and calculation sheets to the undersigned representatives.

5) Notice of Further Legal Action (Islamabad High Court)

If PTET fails to comply within the above time:

 • We shall be constrained to initiate appropriate proceedings before the Islamabad High Court for enforcement of rights and full implementation of the Supreme Court judgment, including constitutional petition and contempt proceedings, as advised, along with any other lawful relief.

This representation may be treated as a formal joint notice of non-compliance and under-payment due to flawed fixation and arrears computation.

6) Attachments (To Be Filed by Each Pensioner / Group)

Each pensioner (or the joint committee) shall attach as applicable:

 • Copy of PPO

 • PTET pension fixation letters / payment slips (if any)

 • Comparative calculation sheet (GoP rules vs. PTET fixation)

 • CNIC copy (optional if needed for record)

 • Any PTET correspondence already made

We submit this in good faith and in the public interest of lawful compliance, uniformity, and justice for all affected pensioners.

Yours faithfully,

For and on behalf of Affected Ex-T&T / PTCL Pensioners (Joint Committee)
