As directed , here is attached the said last two pages of the reply of the PTET , given on the SC querry regarding reasons of non implementing of their order of dated 12-6-15. As abvious from the reply , as mentioned in these last pages , the PTCL and PTET are unable to implement the said order due to non availability of funds amounting to 22 billion rupees approx. Rather they have requested for not passing any adverse order.In my opinion the HSC can not do this now to reverse its decesion as technically it is impossible. HSC already confirmed its decesion of this type in Muhammad Riaz vs Federation of Pakistan in C.P 797/2015, the detail of which I have mentioned in my Article -22 (19-6-16) which I have already cc to you through email of dated 19-6-16. Now , as I think , the HSC should declare PTCL bankrupt and to order Federal Govt to pay this amount to all such PTCL pensioners, being guarantor as specified by HSC in Masood Bhattie case reported in 2012 SCMR 152 [ last para of Para-18 " The only effect of the guarantee is to insure that in the event PTCL becomes incapable of fulfilling obligations as to pensionary and other benefits for the reasons such as bankruptcy etc. The employees do not suffer from such even of default. Protection of Federal Governament would not be available latter category of employees who joined PTCL after 1-1-1996]. Do you think that FG will be capable for making of such payment other wise she would suffere a drastic action from SC for non implementing its order ???
