Re: S.COURT ORDER DATED 15-02-18

Dear Najem Sb as I know these order are passed  for only ptetioner pensioners retired normally.Genrely court always passes order for those who file the case.But all such order in favour of ptetioner or ptetioners if they are govt servants , are also applicable to all those who are not part of the said case , in view of SCP ruling in Hamid Akhter Niazi case reported in 1996 SCMR 1185.The best example of it is Masood Bhattie case reported in 2012 SCMR 152, filed by Masood Bhattie, Nasir Ghuri and Dilawase.SC declared them to be a status of civil servants as they were appointed in T& T and then transferred to PTC and on1-1-1996 to PTCL.So all such employees in PTCL became as of same status of civil servants.
I am doubt that PTCL will apply this decision of 15-2-18,in compliance of SCP such ruling on other such pensioners , who were not part of the Contempt  case filed by Sadiq Ali and others.
So all  such should serve them notice first for the same increase in pension as per GoP with in 15 days failing which , the contempt case would be filed against them by such others who were not the party previously.
In this regard I have already sent you draft model draft of such notice.Now it is the time for you and all such to file case after serving notice after receipt of order sheet of the decision of dated 15-2-18

Most of the PTCL Pensioners not understood S.Court order dtd 15.02.18.   What it mean by Regular Retired Petitioners ???  Its mean those Regulars Pensioner who went in the court and were  petitioners if  I am right than very limited Pensioner will get the payment as asked by the court.  Please clarify if can. Its a question ???
If PTCL / PTET not comply or not pay to Regular Retired Petitioners Pensioners than they will again go to Court ???
