Subject:
Request for Urgent Release of Commuted Portion of Pension After 72 Years of Age as Required by Law.
Dear Sir,
I trust this letter finds you well. I write to you directly to address a pressing matter concerning the restoration of pension rights. Recent rejections by the Director Pension Lahore, citing the matter as "sub judice," have raised serious concerns among pensioners, myself included. This assertion, without clear communication or understanding, has left many of us puzzled and in need of urgent clarification. In light of these developments, I am forwarding my case for the restoration of my commuted pension directly to your esteemed office.
Enclosed are the necessary documents, including the first three pages of my pension book (PPO) bearing number #, two recent photographs, and a photocopy of my CNIC (bearing # ), all essential for the restoration of my commuted pension. My date of birth is. .
I was appointed in T& T departement in. . . . .and retired fro the post of. . . . (B-) on . . . .
As per the regulations outlined in the updated commutation table rules of 2001, I am entitled to the release of the [insert percentage]% commutation pension along with arrears, effective from [insert date]. This release is not only a matter of financial importance but also critical for my overall well-being and security in my advanced years.
Allow me to provide a comprehensive overview of the pertinent facts surrounding this issue:
Career History: I commenced my career with the Telegraph and Telephone Department (T&T) of the Federal Government of Pakistan, which later underwent restructuring, evolving into the Pak Telecom Corporation in 1991. Subsequent to further reorganization in 1996, the entity was rebranded as the Pakistan Telecommunication Company Limited (PTCL). Throughout these transitions, myself and my fellow colleagues were assured continuity under clause 35(2), with the protection of our terms of service under section 59(2) of the Pakistan Telecommunication (Reorganization) Act, 1996.
Legal Safeguards: The legislature, recognizing the importance of safeguarding our terms of service, including pensionary benefits, incorporated additional protections through section 36, Pakistan Telecommunication (Reorganization) Act, 1996.which provided a guarantee against defaults by PTCL. To administer this guarantee, PTET was established, wef 1st January 1996 as per Section -44 of Pakistan Telecommunication ( re- organization ) Act 1996 , entrusted with the responsibility of managing contributions from PTCL and ensuring the timely disbursement of monthly protected pensions, to guaranteed pensioners in accordance Civil Pensions (Commutations Regulations) Federal Pension Rules . These obligations are clearly delineated in the statutory trust deed dated 2nd April 1994, as per Section -45 of the Pakistan Telecommunication ( re- organization ) Act 1996
1996.
Current Issue: Despite the clear statutory obligations stipulated by the Civil Pensions (Commutations Regulations) Federal Government of Pakistan and the trust deed, the release of the commuted portion of my earned gross pension, which was commuted for 12 years, has regrettably not materialized as expected. This delay persists despite being expressly allowed by the Federal Government, as per notifications from the Finance Wing dated 07 July 2015 and 09 February 2016. As a retired employee who dedicated years of service and contributed to the success of the organization, I implore your immediate attention to rectify this matter.
In addition to the aforementioned documents, I have also attached a copy of my life certificate to facilitate the processing of my request.I implore PTET to fulfill its legal obligations promptly and ensure the timely release of the commuted portion of my pension, as stipulated by established regulations.Your prompt attention to this matter is greatly appreciated, and I kindly request regular updates on the progress of my request.
Thank you for your understanding and cooperation in resolving this issue swiftly.
Sincerely Yours,
