Dear Sir,
I........s/o, d/o...... was appointed on regular
post of .......grade...... on the date............ in the region
..........city........ of *Pakistan Telegraph & Telephone
Department*/^^Pakistan Telecommunication Corporation^^. **After the
establishment of PTC in December 1991 , my service had been
transferred along with other all employees from T&T department to PTC
on the same terms & conditions as I had just before my transfer in T&T
department** . Whereas on 1-1-1996 ,I stood transferred again from
PTC to PTCL ie a new established company , along with other employees
from PTC on the same terms and conditions of services , which I had in
PTC and became the employee of PTCL wef 1-1-1996
Presently I am working as a _______ in BPS_______at __________
(Place) OR I have been retired from PTCL service wef ___________ from
the post of _____________ BPS _________ from______________(Place).
The Honourable Supreme Court of Pakistan in its decision reported in
Masood Bhattie & others vs Federation of Pakistan & Others (2012 SCMR
152) , which has been attained finally after dismissing your CRP by
HSC against it vide HSC short order of dated 19-02-2016 of which
detailed order was issued on 16-3-2016 , thus it has been attained
final that the employees in PTCL who stood transferred from PTC to
PTCL and became the employee of PTCL wef 1st January 1996 , would be
be governed by the statutory rules of govt of Pakistan and their terms
and conditions of service ( as envisaged in Section 3 to section 22 of
Civil Servants Act 1973 ) PTCL has no power to alter such terms and
conditions of service for their disadvantage .
Where also , in the light of this judgement , the Hnourable Supreme
Court of Pakistan declared (as reported in 2015 SCMR 1783 Muhammad
Riaz Vs Federation) , that Muhammad Riaz being employee of same
category , is entitled of all such increase in pay and pension as
announced by Federal Govt to its employees and accordingly ordered to
pay encashment of 360 days pay instead of 180 days in lieu of
un-availed LPR, revised pay scales, calculation of pensionery benefits
under revised pay scales etc.
Since , I , being the employee of same category & having the same
issue , hence I am also entitled of same benefits as announced of
Federal Government 's employees time to time.
It is requested that the arrears of total claimed amounts emoluments
of such govt benefits etc of Rs _____________ , be disbursed to me
within 15 days, the claim detail of which is given in the "attached
claimed amount list" If no such action is taken within given
stipulated period of times ,then I will be constrained to knock the
door court , to get my legitimate rights.
