As you know that there were about   400 ptetions were pending since Juneb 2006 in SHC, against victimization of PTCL  new mangement .All these petitions filled by those PTCL  employees who were appointed in T& T dept , were dissmissed by SHC on technical ground of order of June 2010 .Only  Masood Bhattie, Nasir uddin Ghuri and Dil Awaiz( who were appointed T&T Deptt ) had filled appeals in SCP against such order of  SHC who had dissmissed such type long pending ptetions about such 400  of PTCL transferred employees ( I had also filled in August 2006 but I could not file appeal in SCP as I was in abroad ie in Caneda) 

The petitions  were all those ptcl employees , who were appointed in erstwhile T&T dept and then transferred to PTC as per section 9(1) of ptc act 1991 on the same terms and conditons of service as that  they had immidiately before in T&T dept  and on the estab of ptcl all such again transferred to ptcl as per Sec 35 & 36 PT(re-Org) Act 1996.Which means they had same pisitions in ptcl as in t&t and in ptc.So they had right to invoke the jurisdiction of High Court under Article -199  of CoP.

But the SHC dissmissed all such ptetions on the plea, since PTCL has no Statuory Rules hence they had no right to file their petitions under Article 199 of CoP.

The HSCP,  in said Masood Bhatte case 2012 SCMR 152 set aside such order of SHC and clearified  all such appellants were appointed in T& T hence ie who first transferred to PTC , having same statuory rules and then transferred to PTCL from PTC on 1-1-1996 and became the employees of PTCL , hence they would be governed by statuory rules of GoP in PTCL,and PTCL and even Govt have no power to alter their service terms and conditions for their disadvantages. Since the appealants were appointed in Govt T&T departement , so there were apprehensions among some those employees who purely appointed in PTC,  that only those employees who transferred from PTC to PTCL  , on 1-1-1996 , would be governed by statuory rules in PTCL, who were appointed only appointed in T&T and not for those who appointed in "PTC".  

Through the said attached Notification of dated 

9-1-1992( sent to me by some one on WhtsApps), it has been cleared  that the same Statuory Rules of GoP were being  applicable in PTC  till new rules had to be framed for the Corporation ie  PTC. But no such in  rules were framed in PTC and it was bifurcated in to 5 intities after Dec 1995  .PTCL is one of 5 intities and the same and all statuory rules were  remain intacted in PTCL .This also had been clearified by HSCP in said Masood Bhati case.

So this Notification, attached just  the satisfictions for those  transferred employees who were appointed in PTC between 20th Dec 1991 to 31st Dec1995, and were worried wheather  they had Statuory Rules provision in PTCL or not , like just had by those appointed, in T& T Dept.

Why you are reinventing wheel? Janab Tariq Azhar Sb should now get BPS-2005 onward for all transferred employees. Ibne safi ka novel band karain. No need to beat drum. Move forward. You can lead only if you have the courage to get your own rights first.

میں ایک اھم بات اپنے ان پی ٹی سی ایل کے ان پریشان ساتھیوں  دوستوں سے کرنا چاھتا ھوں جو اس بات پر پریشان رھتے ھیں  جو PTC میں  بھرتی ھوئے کے  آیا انکا PTCL میں یکم جنوری 1996 کو ٹرانسفر ھو نے کے بعد   T&T میں بھرتی ھونے والوں جیسا status ھے یا نھیں  . یاد رکھیں ایسے لوگ پاکستان ٹیلی کمیونیکیشن کارپوریشن ( PTC)  میں باقاعدہ کارپوریشن میں رائج T&T والے قانون کے مطابق ریگولر پوسٹوں پر بھرتی ھوئے تھے اور وہ جو T&T  میں ایڈہاک، ورک چارج پر کام کرتے ھوئے PTC میں دسمبر 1991 میں اور ریگولر ملازمین کے ساتھ ھی PTC میں ٹرانسفر ھوگئے اور بعد میں PTC میں انکو ریگولر کردیا گیا ایسے تمام لوگ  باقاعدہ اس کٹیگری میں آگئے جس طرح  وہ دیگر ریگولر ملازمین جو T&T میں بھرتی ھوئیے اور PTC کے ملازمین بن گئے ، پی ٹی سی ایکٹ ۱۹۹۱ کی کلاز (۱)۹ کے  تحت انھیں سروس ٹرمز اور کنڈیشنس  پر جو انکے PTC میں فورن ٹرانسفر سے پہلے T&T میں تھیں [ یاد رھے یہ سروس ٹرمز اور کنڈیشنس وھیں ھیں جو سول سرونٹ ایکٹ 1973 میں دیں گئیں ھیں ]  PTC میں تمام ٹرانسفر ھونے سے پہلے ایسے تمام ملازمین T&T میں سول سرونٹ کہلاتےتھے اور پھر جب یہ تمام PTC میں کام کرنے والے ملازمین چاھے وہ T&T سے ٹرانسفر ھوکر آئے ھوں یا PTC میں ھی ریگولر بھرتی ھوئے یا ریگولر ھوئے ھوں،  جب یکم جنوری 1996 کو کمپنی یعنی PTCL میں ٹرانسفر ھوکر اسکے ملازمین بن گئے تو انپر PTCL میں  ، سپریم کوڑٹ میں مسعود بھٹی کیس  (2012SCMR152) کے تحت  صرف گورنمنٹ کے Statuory Rules ھی استعمال ھونگے یعنی جو انپر T&T اورپھر وھی PTC میں تھے . چونکے مسعود بھٹی کیس میں جو بھی appellant تھے وہ T&T میں بھرتی ھوئے تھے اسلئے عدالت انھی کے بارے میں زکر کیا جس سے کچھ ان ملازمین کو جو  PTC میں ڈائریکٹ بھرتی یا ریگولر ھوئے تھے ، ان میں یہ تاثر پیدا ھورھا تھا کے شائید وہ اس کٹیگری میں نہیں آتے جس کا زکر سپریم کوڑٹ نے مسعود بھٹی کیس مں کیا ھے .ایسے کچھ لوگ مجھ سے بار بار یہ ھی پوچھتےتھے ان کا PTCL status  میں کیا ھے ؟ . میں ھمیشہ انکو یہ ھی بتاتا تھا کے وھی جو T&T  میں بھرتی ھونے والوں کا . سپریم کوڑٹ نے بھی اپنے اسی مسعود بھٹی کیس کے پیرا نمبر 9  میں صاف لکھا کے اپیلنٹس پر PTC میں Statuory rules  ھی استعمال ھورھے تھے اور اسی پیرا 17  میں لکھا کے "جو ملازمین  کارپوریشن (PTC) سے یکم جنوری 1996 کو PTCL میں ٹرانسفر ھوئے تھے انکے  سروس ٹرمز اور کنڈیشنس مں منفی تبدیلی نہیں کی جاسکتی جس سے انکو نقصان پہنچے" [  ظاہر ھے کارپوریشن میں دونوں کٹیگری کے ملازمین تھےیعنی جو ٹرانسفر ھوکر آئے اور جو کارپوریشن میں ریگولر بھرتی یا جو ریگولر ھوئے].

مبھے واٹس ایپس پر آج یہ PTC کے ۹ فروری ۱۹۹۲کی یہ مندرجہ زیل , اسوقت PTC کے بوڑڈ سے منظور شدہ یہ نوٹیفیکییشن کی کاپی ملی، جس میں صاف صاف لکھا کے تا وقتیکے PTC کے اپنے رولز اور procedures  نہیں بن جاتے ، PTC میں سابقہ T&T والےرولز اور procedures ھی استعمال ھونگے . PTC کے یہ رولز تو اس سکے اختتام تک نہ بن سکے اور PTC پانچ حصوں میں تقسیم ھوگئی جس میں ایک حصہ یہ PTCL ھے جس میں وھی T&T والے رولز اور procedures استعمال ھورھے تھےجو PTC میں ھورھے تھے . جسکو مزید authenticated , سپریم کوڑٹ نے اپنے مسعود بھٹی کیس کے فیصلے میں 7 اکتوبر 2011   کو کیا اور اسکے خلاف PTCL کی رویو پٹیشن بھی 19 فروری 2016 کو خارج ھوگئی ، مگر موجودہ PTCL انتظامیہ  اسکے خلاف کام کررھی ھے اور عدالت عظمی کے احکامات کو ردی کی ٹوکری میں ڈال رھی ھے.
