An Email to Secretary (MoITT) for th implementation of Senete Resoulation and IHC order

نوٹ:- یہ آج میں نے ایک اور ای میل جناب شعیب احمد صدیقی سیکریٹری (MoITT) کے نام بھیجی ھے اور اسکی کاپی چئیرمین سینیٹ کو بھی بھیجی ھے ۔ انکو میں نے یہ عرض کیا ھے کے وہ چاھیں تو بوڑڈ آف ٹرسٹیز ، اپنے گورمنٹ کے ممبران کی ووٹ کاسٹ کی نیاز پر اپروول لے سکتے ھیں اور ھمیں یہ پیمنٹ کراسکتے ھیں ۔ ان کو میں نے یہ بھی متنبہ کیا کے بوڑڈ آف ٹرسٹیز کے ممبران ، ایم ڈی گزشتہ پانچ سالوں سے ، سپریم کوڑٹ کے ۱۲ جون ۲۰۱۵ کے فیصلے پر بلکل عمل نہیں کر رھے اور اپنی مرضی سے پنشن سالانہ انکریز کررھے ھیں اور اس کے مطابق نوٹیفیکیشن نکالے جارھے ھیں ۔ یہ سب لوگ سخت توھین عدالت کے مرتکب ھورھے ھیں ۔ ۱۲ جون ۲۰۱۵ کے فیصلے بعد اس وقت سے اب تک جو بھی بوڑڈ کے ممبران چاھے وہ گورمنٹ کے ھوں یا پی ٹی سی ایل کے ھوں اور جو اب بھی موجود ھیں ، اور اپنے تئیں سالانہ پنشن انکریزز دے رھے ھیں جو انھوں نہ صرف اور کم ھی نہیں کردی بلکے اسکو دو حصوں میں بانٹ دیا ھے ، وی ایس ایس کے لئی الگ اور نارمل ریٹئیڑڈ کے لئیے الگ ۔ جبکے ایسی کوئی بات گورمنٹ کے اپنے نوٹیفیکیشن میں نھیں ھوتی ھے ، جسکے مطابق ھی انھوں نے عمل کرنا تھا جو یہ بلکل نہیں کررھے ۔ تو یہ سب لوگ سخت توھین عدالت کی سزا کے مستحق ھیں

Respected Sir

                               It is regretted to point out that you are not seems to be  able to get the approval of Board of Trustees , in connection to implement the Senate Resolution of 28 January 2020 and the decision of Islamabad High Court March 3, 2020,  for  making payments of GOP announced  Pension increase to PTCL Pensioners  and Petitioners . This could be done by easily , from the the Board of Trustees, based on a majority votes of three members , belongs Ministry of Information  Technology & Telecom Government of Pakistan .There is no any precedent like that of the such Board of Trustees , contemplating of the Supreme Court for not acting in accordance with the spirit of its June 12, 2015 decision .  According to the said judgment of HSC , they were bound to pay GoP announced pension increases to  the PTCL employees ,who had been retired from Corporation and Company  , after their transfer to there.  They  never complied with the order of the Supreme Court and always increased annual pension of such PTCL Pensioners as per  own discretion.And also, on the contrary to it, they reduced it to from 8% to 6.5% for those who were normally retired and 5.5% for those who had been retired with VSS.  Just to show that how much they respect the orders of the Supreme Court ? All the members Board of Trustees , Managing Director, General Managers and some others have put an end to dishonesty. With what brazenness are these people , constantly violating the orders of the Supreme Court for the last five years and no one is going to ask them? .They all are deserved strict contempt of court proceedings under Article 204(2)(a) of the Constitution. This article grants the Court the power to punish for contempt any person who “disobeys any order of the Court” as directed by HSC in the case ie Syed Mahmood Akhtar Naqvi and others. Vs. Federation of Pakistan and others” commonly known as Ms. Anita Turab case (PLD 2013 S.C. 195).

Against the order of IHC dated 3rd March , 2020  ,  PTET has filed  Intra Court Appeals against all 35 petitions,  in very hurry manner just to take stay order as soon as possible, for non implementation, but their request for the same has been rejected by the IHC double bench on 16th July 2020. Since then then to till date ,they could not implement the same . It is not clear why they filed intra-court appeals against the court's decision on those petitions which did not contain any disputed matter  .In  which the prayers were  made for the payment GoP pension increases arrears only , which PTET had already  paid to 343 , such type petitioners as per HSC order of dated 15th Feb 2018. The HSC issued such order in accordance to the decision of dated 12th June 2015 . 

In our writ petition (4588/2018) , we have only prayed for the same ie  the payment  the GoP pension increases  only and not for any other thing else . So what is their abomination in not giving it to us which is beyond our comprehension.  Why they are discriminating with us and grossly violating Article 27 of the Constitution of Pakistan.

It is humbly requested you again , let get the  approval of Board of Trustees for the payment  the arrears of Government Pension Increases as per the said resolution of the Senate and of the orders of such order of IHC for the entitled/  eligible petitioners . The lists of 21 entitled/ eligible petitioners , out of 32 petitioners , of our writ petition # WP-4588/2018,already sent to you earlier , again reattached here with for your kind perusal .

An early action in this regard is solicited please , without any further loss of time.Thanks
